Tenant rights in India: what every renter should know
Tenants · 2 min read · Updated
Tenancy law in India is set mostly by states, so details differ. These are the points most tenants can expect, and what to put in writing.
A written agreement
You can ask for a written, stamped agreement. It is your main proof of the terms, and landlords benefit from it too.
Rent receipts
You are entitled to proof of payment. Ask for a receipt or pay by bank transfer so there is a record.
Notice before ending the tenancy
The agreement should state the notice period for both sides. Under general law, a landlord cannot simply throw a tenant out without following the process. If you are asked to leave suddenly, check your agreement and your state's rent law, and consider legal advice.
Privacy
A landlord does not have an open right to enter the home you rent. Good agreements require reasonable advance notice for inspections, and ours use 24 hours' written notice.
Fair handling of the deposit
Insist on a clear refund timeline and itemised deductions, and keep move-in photos.
No unfair conditions
Clauses that restrict tenants because of religion, caste, diet or similar grounds are a problem. Our tool refuses to draft them.
Common questions
- Can my landlord raise rent any time?
- Only as the agreement allows, or under a new agreement. Read the renewal and increase clause.
- Can I be evicted without notice?
- Generally no. The process and notice depend on your agreement and state law.
