How to make a rent agreement online in India: step by step

You can draft a rent agreement online in a few minutes, but the document only becomes useful once it is stamped and signed correctly. This guide covers the whole path, from gathering details to keeping your copy safe.
1. Gather the details first
Having everything ready makes drafting quick and avoids errors that are annoying to fix after printing.
- Full names and permanent addresses of the landlord and the tenant
- The exact address of the property, as written on the ownership papers
- Monthly rent, security deposit, and the day of the month rent is due
- Start date and term, usually 11 months for homes
- Maintenance, lock-in and notice period you have agreed on
- Aadhaar and PAN of both parties for the final document
2. Choose the right format for your state
Most states use a lease or rental agreement. Maharashtra uses a Leave and License agreement for residential premises. The wording differs, so pick a tool that follows your state's format. Our state pages show the format and stamp duty basis for each state we cover.
3. Read every clause before you pay or sign
A draft is only as good as the terms in it. Check the rent and deposit amounts, the refund timeline for the deposit, who pays maintenance, how much notice each side must give, and whether subletting is allowed. Ask for changes before signing, not after.
4. Stamp the agreement
Print the agreement on stamp paper or pay the duty through your state's e-stamp portal. The amount depends on your state, the rent and the term. Treat any figure you see online, including ours, as indicative and confirm it on the official portal before paying.
5. Sign, witness and keep copies
Both parties sign every page, usually with two witnesses. Each side keeps an original. Also keep rent receipts for every payment: tenants need them for HRA claims, and both sides need them if there is a dispute.
6. Check whether registration is needed
A lease longer than one year generally has to be registered under the Registration Act, 1908. Maharashtra also requires Leave and License agreements to be registered. If you are unsure, ask the sub-registrar's office or a local lawyer.

- A rent agreement is valid when it is properly stamped and signed by both parties, however the text was drafted. Drafting online does not change that. Stamping and, where required, registration are what matter.
