Rent agreement clauses checklist: 15 things to include
Basics · 2 min read · Updated
A short agreement with clear clauses prevents more disputes than a long one with vague ones. Use this checklist before you sign.
The essentials
Make sure each of these is in the draft:
- Names and addresses of both parties
- Exact property address and what is included
- Start date, term and end date
- Monthly rent, due date and payment method
- Security deposit amount and refund timeline
- Maintenance and utility responsibilities
- Lock-in period, if any
- Notice period for both sides
- Renewal and rent increase terms
- Repairs and who pays for what
- Inspection with advance notice
- Subletting rules
- Fixtures and appliances list
- Stamp duty and registration costs
- Governing law and jurisdiction
Check the numbers twice
Rent, deposit and dates are the most common typos. Read them out loud against the payment you actually agreed.
Add what is specific to you
Pets, parking, guests, and use of common areas belong in the agreement if they matter. On our Plus plan you can write them in plain language and they are added as a clause.
Common questions
- Does a longer agreement protect me more?
- Not necessarily. Clear, specific clauses matter more than length.
- Can I change the draft after printing?
- Not by hand-writing, without both parties initialling every change. It is cleaner to fix the draft and print again.
