Leave and License vs lease agreement: key differences

Legal · 2 min read · Updated

Both documents let someone live in a property for rent. Legally they are different, and the difference decides what rights the occupant has.

What a lease does

A lease transfers the right to enjoy a property for a period in exchange for rent. The tenant gets an interest in the property for that time. Most Indian states use a rental or lease agreement for homes.

What a Leave and License does

A license only gives permission to occupy. It does not transfer any interest in the property, so the person occupying (the licensee) does not become a tenant in the legal sense. This distinction matters under rent control laws.

Why Maharashtra uses it

In Maharashtra, residential arrangements are normally documented as Leave and License agreements, and they must be registered. Our drafts for Maharashtra use Licensor and Licensee wording and a license fee instead of rent for that reason.

Which should you use?

Use the format that your state's practice and law expect. Do not switch the label to get a different result, because courts look at what the arrangement actually is, not what it is called. If your situation is unusual, such as a long term or a commercial premises, speak to a local lawyer.

Common questions

Is a licensee a tenant?
Generally not. A licensee has permission to occupy but no interest in the property.
