Notarised vs registered vs e-stamped rent agreement
Legal · 2 min read · Updated
People use these three words as if they meant the same thing. They do not. Each is a separate step with a different purpose, and the one you cannot skip is stamping. This guide explains them in order.
E-stamped: the duty is paid
Stamp duty is a state tax on the document. Paying it, usually through the state's e-stamp or registration portal, gives you the stamped paper or a certificate to attach. Without the right duty, a rent agreement may not be accepted as evidence in court until the duty and any penalty are paid.
The amount depends on the state, the rent and the term. Our state pages show the basis each state uses.
Notarised: someone witnessed the signatures
A notary attests that the people who signed are who they say they are. That adds credibility, and many employers and banks like to see it. It does not make the terms legal, and it does not replace stamping or registration.
Notarisation is not a legal requirement for a rent agreement in most states, but it is common in practice.
Registered: the agreement is on the public record
Registration happens at the sub-registrar's office, and in some states online. Under the Registration Act, 1908, a lease longer than one year has to be registered. That is why most agreements are for 11 months.
A few places are stricter. Maharashtra requires Leave and Licence agreements to be registered whatever their length, and Tamil Nadu's 2017 tenancy Act is described as requiring registration of rental agreements. Check your state page.
Which ones do you need?
For a typical 11-month home rental in most states you need the agreement to be correctly stamped and signed by both sides. Notarisation is a sensible extra if someone will ask for it. Registration is needed for longer terms and in the states above.
If you are unsure, ask the sub-registrar's office or a local lawyer before you sign.
Common questions
- Is a notarised agreement enough without stamp paper?
- No. Notarisation does not pay stamp duty. An agreement that is not stamped can be refused as evidence until the duty and any penalty are paid.
- Do I have to register an 11-month agreement?
- In most states, no. In Maharashtra and, according to the state's 2017 Act, in Tamil Nadu, registration is expected whatever the term. Check your state page.
- Who pays for stamping and registration?
- The law does not fix this for private tenancies, so the agreement decides. Splitting it equally is common.
